Terms & Conditions

§1 General provisions

1. These Terms and Conditions govern the use of the Obsidian Studio online shop, the placing of orders, the conclusion of contracts of sale, the processing of orders, the right of withdrawal, liability for defects and the provision of services by electronic means.

2. The owner of the Obsidian Studio online shop is Natalia Mikulska-Yildirim, business address Graf-Wilhelm-Straße 28, 89613 Oberstadion, Baden-Württemberg, Germany. The main channel of contact is the e-mail address info@obsidianjewels.com. Contact via WhatsApp is additionally available on +49 151 68581336, in written form only.

3. The shop operates in accordance with applicable German law and with the relevant provisions of European Union law on distance selling and consumer protection.

4. For consumers habitually resident in another Member State of the European Union, the choice of German law does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence.

5. These Terms and Conditions are available free of charge on the shop's website in a form allowing them to be saved, downloaded or printed.

6. The main language of the shop is German. These Terms and Conditions are provided in German, English and Polish; versions other than the German one are supplementary in character. In the event of any discrepancy between the language versions, the German text prevails. This does not limit the protection afforded to consumers by the mandatory provisions of the law of their country of habitual residence.

§2 Definitions

1. Customer – a natural person, legal person or legally capable partnership making a purchase through the shop.

2. Consumer – a natural person entering into a legal transaction for purposes which are predominantly outside their trade, business or profession.

3. Seller – Natalia Mikulska-Yildirim, owner of the Obsidian Studio brand.

4. Shop – the Obsidian Studio online shop available at obsidianjewels.com.

5. Object – the goods offered for sale through the shop.

6. Ready-to-ship object – an object physically in the Seller's possession, offered in a specific size and variant and in a limited number of pieces, which can be dispatched without being made first.

7. Object made to order – an object crafted by hand after the order has been placed, according to a design available in the shop, in the size and variant chosen by the Customer.

8. Discount code – a sequence of characters provided by the Seller entitling the holder to a reduction of the order value on the conditions stated when it is issued.

9. Distance contract – a contract concluded between the Customer and the Seller without their simultaneous physical presence, using exclusively means of distance communication.

10. Contract of sale – a contract concluded between the Customer and the Seller through the online shop.

§3 Objects and their characteristics

1. Obsidian Studio offers handmade jewellery in 925 silver.

2. Most objects are crafted by hand after the order has been placed.

3. Because of the handmade nature of production, individual pieces may show slight, natural differences in finish. These differences affect neither the function nor the essential characteristics of the object and are a natural feature of handcrafted work. This does not exclude or limit the statutory rights of consumers.

4. Objects may contain natural precious and semi-precious stones. Because of their natural origin, every stone is unique and may differ in colour, structure, veining or shade. Differences within the range of natural variation of the given type of stone do not in themselves constitute a defect.

5. Product photographs show the objects offered. The shade, colour or saturation perceived in photographs may differ depending on the settings and calibration of the Customer's screen.

6. The Customer is responsible for choosing the size, variant and other options available during the ordering process, provided that the Seller has made available accurate supporting information enabling that choice.

7. The Seller makes supporting information on sizes available in the shop, in particular the article "How to Find the Right Ring Size" in the Field Notes section.

8. An incorrect choice of size or variant made by the Customer, where the Seller has properly provided supporting information, does not in itself constitute a lack of conformity.

9. Silver 925 is a material naturally prone to oxidation. In normal use it may darken, become matt or change shade over time. Changes resulting from the natural properties of silver and from normal use do not in themselves constitute a lack of conformity.

10. How quickly such changes occur may depend, among other things, on the manner of use, contact with water, cosmetics, perfume and chemicals, air humidity, and individual wearing characteristics.

11. Natural signs of use arising from ordinary wear — such as fine scratches, dulling of the surface or natural oxidation of silver — do not in themselves constitute a lack of conformity.

12. The provisions of this paragraph do not limit the statutory rights of consumers under the rules on conformity of goods with the contract.

13. The Seller makes available in the shop the article "Jewelry Care" in the Field Notes section, containing guidance on the correct use, storage and care of objects.

§4 Electronic services

1. The Seller may provide the following electronic services through the shop: a) a contact form, b) the placing of orders through the shop, c) access to the order status view via an individual link sent by e-mail.

2. Use of the shop requires: a) a device with internet access, b) a current web browser, c) an active e-mail address.

3. Contracts for the provision of electronic services are concluded for an indefinite period and may be terminated by the Customer in accordance with the provisions of these Terms and Conditions applicable to the service concerned.

4. The Customer undertakes to use the shop in accordance with applicable law and good practice.

5. Supplying unlawful or offensive content, or content capable of disrupting the operation of the shop, is prohibited.

§5 Conclusion of the contract of sale

1. The information presented in the shop does not constitute a legally binding offer, but an invitation to place an order.

2. Orders may be placed through the shop's website 24 hours a day.

3. Placing an order requires the provision of the data necessary to process it, acceptance of these Terms and Conditions and confirmation that the Customer has read the Privacy Policy.

4. Once payment has been received, the Customer receives an order confirmation by e-mail. It confirms receipt of the order and at the same time declares its acceptance for processing.

5. The contract of sale is concluded when this order confirmation reaches the Customer.

6. If payment is not completed, no contract of sale is concluded and the order is not processed.

7. The Seller may refuse to accept an order for processing before the contract of sale is concluded where: a) incorrect data has been provided, b) payment has not been made, c) processing is objectively impossible for technical reasons or reasons relating to the availability of the object.

8. If processing of an order is refused, any payments already received will be refunded to the Customer.

9. Persons without full legal capacity should make purchases with the consent of their legal representative.

§6 Prices, currency, discount codes and payment methods

Prices

1. All prices presented in the shop are final prices. Where the Seller makes use of the small-business exemption under § 19 of the German VAT Act, no VAT is charged or shown. The VAT identification number stated in the Imprint serves for tax identification in intra-EU transactions and is not in itself a statement about the Seller's status as a VAT-registered trader.

2. Delivery costs are not included in the price of the object and are shown to the Customer before the order is placed.

Currency

3. The currency of the shop is the euro (EUR). Prices are presented in euro, and payment and any refund are settled in that currency.

4. If the Customer's bank or card issuer converts the amount into another currency, that institution determines the exchange rate and any related charges. The Seller has no influence over these and accepts no responsibility for them.

Discount codes and promotions

5. The Seller may issue discount codes and run promotional campaigns.

6. The conditions for using a discount code, in particular its validity period, any minimum order value, the number of permitted redemptions and the range of objects covered, are stated each time the code is issued.

7. The discount code must be entered during the ordering process. It cannot be taken into account after the contract of sale has been concluded.

8. One discount code may be redeemed per order. Discount codes cannot be combined with one another unless expressly stated otherwise.

9. The restriction in paragraph 8 does not apply to the shop's standing conditions. Delivery within the Federal Republic of Germany is free for orders whose value reaches the threshold stated in the shop. That threshold does not cover deliveries to other countries. The Seller may from time to time extend free delivery to other Member States of the European Union as part of promotional campaigns, on the conditions stated when the campaign concerned is announced.

10. Discount codes cannot be exchanged for cash.

11. In the event of withdrawal, the Seller refunds the amount actually paid by the Consumer, taking the discount granted into account.

12. The Seller may invalidate a discount code used in breach of the conditions of its issue or in a manner amounting to abuse.

Payment methods

13. Payments in the shop are handled through the payment provider Stripe.

14. The payment methods available for a given order are shown to the Customer during the ordering process and may differ depending on the country of delivery, the device and the order value. In particular, credit and debit cards, Apple Pay, Google Pay, Link, Klarna and payment methods customary in individual countries, such as iDEAL, Bancontact, EPS, Satispay or MB WAY, may be offered. When paying with Klarna, Klarna's terms, which are shown to the Customer during the payment process, apply in addition.

15. The Customer is obliged to make payment in accordance with the instructions displayed during the ordering process.

16. The Seller begins processing the order once confirmation of proper receipt of payment has been obtained.

17. If payment is not made, the Seller may cancel the order after first contacting the Customer.

18. The goods remain the property of the Seller until the order has been paid in full (§ 449 of the German Civil Code).

§7 Processing of orders

1. Orders are processed in the order in which they are received.

2. The processing time runs from the moment payment is received, unless the description of the object provides otherwise.

3. Orders are processed on working days only.

4. Should unforeseen circumstances arise which affect the processing date, the Seller will inform the Customer without undue delay.

5. If processing an order proves impossible, the Customer will be informed and any payments received will be refunded.

6. The processing times for the individual types of order are set out in §8 and §9 of these Terms and Conditions.

§8 Ready-to-ship objects

1. Objects marked "Ready to ship" form a separate category of objects which are physically in the Seller's possession and do not need to be made after the order is placed.

2. These objects are offered in the specific sizes and variants stated in the description and in a limited number of pieces. Availability of an object in another size or variant may require an order for an object made to order in accordance with §9.

3. Objects marked "Ready to ship" are dispatched within 1 to 5 working days of receipt of payment.

4. The period stated is the expected processing time and may change in exceptional circumstances beyond the Seller's control.

5. Because of the limited number of pieces, an object marked "Ready to ship" may cease to be available before payment is received. In that case §7 paragraph 5 of these Terms and Conditions applies.

§9 Objects made to order

1. The objects offered by Obsidian Studio are crafted by hand after the order has been placed, according to the designs available in the shop.

2. The production time for objects made to order is 14 to 30 calendar days from receipt of payment.

3. In particular cases the production time may be extended; the Customer will be informed of this by electronic means.

4. The Seller makes every effort to meet the stated periods. The periods stated are the expected processing time.

§10 Delivery

1. Delivery is made within the Federal Republic of Germany and to the other Member States of the European Union. The Seller does not currently deliver outside the European Union. The delivery countries available for a given order are shown during the ordering process.

2. The available delivery methods, delivery costs, carriers and tracking arrangements are set out in the separate document "Shipping & Delivery Times", which forms an integral supplement to these Terms and Conditions.

3. The Customer is obliged to provide a correct and complete delivery address.

4. If delivery fails because the Customer provided an incorrect address or did not accept the parcel, the Seller may charge the Customer the actual cost of re-shipping, unless mandatory provisions provide otherwise. This does not limit the Consumer's rights under applicable law, including the right of withdrawal.

§11 Receipt of the parcel

1. The Customer should check the condition of the parcel immediately upon receipt.

2. If damage in transit is found, it is advisable to draw up a damage report in the presence of the carrier.

3. A damage report may make it easier to pursue claims against the carrier.

4. Failure to draw up a damage report does not deprive the Consumer of rights arising under applicable law.

§12 Portfolio and promotional materials

1. The Seller reserves the right to take photographs of objects made by Obsidian Studio.

2. The Seller may use photographs of completed objects for promotional and marketing purposes and to present the brand portfolio.

3. Published materials will not contain personal data of the Customer allowing their identification without their express consent.

4. Where photographs of objects include the Customer's image or parts of their body allowing identification, their publication requires the Customer's prior express consent in accordance with applicable data protection law.

§13 Right of withdrawal

1. A Consumer has the right to withdraw from a distance contract without giving reasons within 14 days of receiving the goods, subject to the exceptions provided for by applicable law.

2. Where an order covers several goods delivered separately, the withdrawal period starts on the day the Consumer receives the last of them (§ 356(2) of the German Civil Code).

3. Detailed information on exercising the right of withdrawal is contained in the separate document "Right of Withdrawal, Returns and Complaints", made available to the Customer in accordance with applicable law.

4. To exercise the right of withdrawal, the Consumer must make an unequivocal statement of withdrawal.

5. The Consumer may use the model withdrawal form, but this is not obligatory.

6. The Consumer bears the direct cost of returning the goods, unless applicable law provides otherwise.

7. We recommend securing the item appropriately for transport.

8. The Consumer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning (§ 357(7) of the German Civil Code).

§14 Refunds

1. In the event of an effective withdrawal, the Seller will refund all payments received from the Consumer, including delivery costs to the extent required by applicable law.

2. The refund will be made no later than 14 days from the day the statement of withdrawal is received.

3. The Seller may withhold the refund until the returned goods have been received or the Consumer has supplied evidence of having sent them back, whichever is the earlier.

4. The refund will be made using the same means of payment as was used for the purchase, unless the Consumer expressly agrees to another method. The Consumer incurs no charges as a result.

5. If the original means of payment cannot be used, the refund may be made by transfer to a bank account indicated by the Consumer.

§15 Exclusion of the right of withdrawal

1. The right of withdrawal is excluded solely in the cases provided for by applicable law.

2. Where the right of withdrawal is excluded for a particular object, the Consumer will be expressly informed of this before the contract is concluded.

§16 Liability for defects

1. The Seller is liable for the conformity of the goods with the contract in accordance with applicable law.

2. The Consumer has the statutory rights arising from the rules on conformity of goods with the contract.

3. Claims for defects become time-barred two years after delivery of the goods to the Consumer (§ 438(1) no. 3 of the German Civil Code).

4. Detailed information on withdrawal, returns and liability for defects is contained in the separate document "Right of Withdrawal, Returns and Complaints".

5. Liability for defects does not extend to damage arising after delivery of the goods where it results from circumstances attributable to the Consumer. This applies in particular to improper use, storage or cleaning, unauthorised interference with the object, mechanical damage, dropping, contact with water or chemicals, and other circumstances not caused by a defect in the goods.

6. Detailed guidance on the correct use, storage and care of jewellery is available in the article "Jewelry Care" in the Field Notes section.

7. The Consumer is liable for damage to or destruction of the goods only to the extent that they are responsible for it.

§17 Liability for conformity of the goods with the contract

1. Where a lack of conformity of the goods with the contract is established, the Consumer has the remedies provided for by applicable law.

2. The provisions of these Terms and Conditions do not limit the Consumer's rights under mandatory provisions of law.

§18 Intellectual property

1. All content placed in the shop, in particular photographs, graphics, designs, object descriptions, logos, trade marks and other materials, is legally protected.

2. Copyright and other intellectual property rights in the materials published in the shop belong to the Seller or to those who have granted the Seller appropriate licences.

3. Use of the materials placed in the shop beyond the scope permitted by applicable law requires the Seller's prior consent.

4. The purchase of an object does not transfer to the Customer any economic copyright or other intellectual property rights relating to the design of the object.

§19 Protection of personal data

1. Customers' personal data is processed in accordance with applicable data protection law, in particular Regulation (EU) 2016/679 (GDPR).

2. The controller of personal data is the Seller.

3. Detailed information on the processing of personal data, on cookies and on the technologies used in the shop is contained in the Privacy Policy available on the shop's website.

§20 Out-of-court dispute resolution

1. The Seller is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body within the meaning of § 36 of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG).

2. The Consumer may pursue their rights before the competent ordinary courts in accordance with applicable law.

§21 Applicable law

1. Contracts between the Seller and the Customer are governed by the law of the Federal Republic of Germany.

2. For Consumers habitually resident in another Member State of the European Union, the choice of German law does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence under Article 6 of the Rome I Regulation.

§22 Amendments to the Terms and Conditions

1. The Seller reserves the right to amend these Terms and Conditions for good cause, in particular where the law changes, where the way the shop operates changes, or where adaptation to decisions of public authorities or court rulings is necessary.

2. Amendments do not affect rights acquired by Customers before the amendments take effect.

3. Amendments take effect on the date indicated by the Seller, but no earlier than 14 days after their publication, unless applicable law requires a different period.

4. Amendments do not affect contracts already concluded, unless applicable law or the Customer's express consent provides otherwise.

§23 Final provisions

1. Matters not regulated by these Terms and Conditions are governed by German law and by the relevant provisions of European Union law.

2. Should any provision of these Terms and Conditions be invalid or unenforceable, this does not affect the validity of the remaining provisions.

3. These Terms and Conditions are available free of charge on the shop's website in a form allowing them to be obtained, reproduced and stored.

4. These Terms and Conditions take effect on 27 September 2026.
